Zivo (“Zivo”, “we”, “us” or “our”) is operated by Edra Labs LLP. This Privacy Policy explains how we collect, use and share information about you when you use our mobile applications, our website at https://www.myzivo.ai, and related services (collectively, the “Services”).

Zivo is an AI conversational companion. The Services are intended for users aged 18 and over. By using the Services you agree to this Privacy Policy and to our Terms of Use.

1. Personal Information We Collect

A. Personal Information You Provide to Us

  • Account Information. Your name, email address, and either a password you choose or the authentication identifier provided by your sign-in provider. You can sign in with Google, with Apple, or with an email address and password.
  • Profile Information. Information you choose to provide during onboarding and afterwards, such as your date of birth, pronouns, how you would like Zivo to address you, your preferences, and details about the people and situations in your life.
  • Content. The messages, audio information (including voice recordings and their transcriptions), images and photographs you send to or share with Zivo, and the memories Zivo derives from your conversations in order to maintain continuity between sessions. The Services allow you to submit these inputs or prompts, which generate responses based on your Prompts (“Outputs”). If you include personal information in your Prompts, we will collect that information, and this information may be reproduced in the Outputs.
  • Purchase Information. Subscriptions are billed through the Apple App Store and Google Play. Those stores collect and process your payment information; we receive your purchase and subscription status and keep a record of your entitlements.
  • Communications. Information you provide when you contact support, report a response, respond to a survey, or send us feedback. If you contact us directly, we may receive personal information about you. For example, when you contact us for customer support purposes, we may receive your name, email address, the contents of a message or attachments that you may send to us, and other information you choose to provide. When you communicate with us, third party vendors may receive and store these communications on our behalf.

B. Personal Information We Collect When You Use Our Services

  • Location Information. When you use our Services, we infer your general location information, for example inferring the city or state, by using your internet protocol (IP) address.
  • Device Information. We receive information about the device and software you use to access our Services, including IP address, web browser type, operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, and push notification tokens.
  • Usage Information. To help us understand how you use our Services and to help us improve them, we automatically receive information about your interactions with our Services, such as the features and screens you view and the dates and times of your visits.

Information from Cookies and Similar Technologies. We and our third-party partners collect information about your activities on our Services using cookies, pixel tags, SDKs, or similar technologies. Our third-party partners, such as analytics, advertising, and measurement partners, may use these technologies to collect information about your online activities over time and across different services. We and our third-party partners may use the following cookies:

  • Essential cookies. Some cookies are strictly necessary to make our website and Services available to you, for example to provide login functionality or for security purposes. We cannot provide you with the website and Services without this type of cookie.
  • Analytics cookies. We use cookies for analytics purposes in order to operate, maintain and improve our website and Services.
  • Advertising cookies. We and our third-party partners may use cookies to present ads to you on sites that are not owned or operated by us, to promote our Services. These cookies are used to make advertising messages more relevant, and perform functions such as preventing the same ad from continuously re-appearing.

C. Personal Information We Receive from Other Sources

  • Information from Sign-In Providers. If you choose to sign in using Google or Apple, we receive the basic profile information that service provides, such as your name, email address and a unique identifier. We do not receive your password. The manner in which Google and Apple use, store and disclose your information is governed by their own policies.
  • Information from App Stores. Apple and Google provide us with purchase and subscription status and, where available, an age range or age category signal, which we use to enforce our minimum age requirement.
  • Information from Discord. If you choose to join our Discord server, we may receive information about you, including your username, display name, ID, profile picture, and your activity in the Discord server. We use this information to manage our community, provide support, and improve our Services. If you wish to limit the information available to us, you should visit the privacy settings of your Discord account to learn about your options. You understand and agree that the use of your information by Discord will be governed by Discord’s privacy policy.

2. How We Use Your Personal Information

We use the personal information we collect to:

  • provide, operate, maintain, secure and support the Services, including creating and managing your account and generating responses to you;
  • personalize your experience, including through Zivo’s memory of your conversations;
  • train and improve our AI models and safety systems, as described in Section 3;
  • understand and analyze how you use our Services, and develop new products and features;
  • detect and prevent fraud, abuse, harmful content and security incidents, and to respond to content indicating a risk of harm;
  • process purchases and manage subscriptions, refunds and disputes;
  • communicate with you, including service and administrative messages and, where you have opted in, marketing and survey emails;
  • measure the performance of our advertising and attribute app installs, sign-ups, and subscriptions;
  • comply with applicable law, enforce our Terms of Use, and establish, exercise or defend legal claims as may be required by applicable laws and regulations or requested by any judicial process or governmental agency;
  • generate de-identified or aggregated information; and
  • for other purposes for which we provide specific notice at the time the personal information is collected.

3. Model Improvement and Your Choices

Our generative AI systems use a variety of data sources, including publicly available data; text content and interaction data from users; internally generated data from safety training, engineering testing, and red-teaming exercises; synthetic data created internally or from open source repositories, and; third parties through commercial agreements. We may use content you share with Zivo to improve our services, including improving the AI models and safety systems that power the Services. Before we use content for this purpose, we take steps to reduce the amount of personal information it may contain by way of de-identifying, aggregating, filtering and processing.

You can email us on our support email below to opt out at any time. Once you opt out, new content will not be used to train our models. You can still send us feedback about Zivo’s responses, and we may still use your information to improve other parts of the Services, such as search, recommendations and safety systems.

4. Sensitive Information

Zivo is designed to function without sensitive information about you, and we do not ask for it. That includes information revealing your health or mental health, your racial or ethnic origin, your religious or philosophical beliefs, your political opinions, your sex life or sexual orientation, your caste or tribe, your citizenship or immigration status, your genetic data, or biometric data.

Please do not share sensitive information you would prefer we did not process at all. Where applicable law requires your explicit consent before we process sensitive personal data, by choosing to provide it after reading this notice you give that consent. You can always request deletion of your account at any time.

5. How We Share Your Personal Information

We share personal information with:

  • Partners and Affiliates. We may disclose any information we receive to our partners, corporate affiliates, parents, or subsidiaries for any purpose described in this Privacy Policy.
  • Vendors and Service Providers. We may disclose any information we receive to vendors and service providers retained in connection with the provision of our Services, such as IT, security or data hosting service providers.
  • AI Providers. We may disclose information we receive to vendors that provide artificial intelligence services that provide backend support for our Services. Our AI Providers are: OpenAI and Anthropic.
  • Service providers who perform services on our behalf, including cloud hosting, product analytics (PostHog and Google), customer support, and email and push notification delivery.
  • Advertising and attribution partners. We advertise Zivo on third-party platforms, including Meta, to reach and acquire new users. To understand whether our ads led to an app install, sign-up, or subscription, we share limited event data — such as app installs and app events — with these platforms for attribution and campaign measurement. Where we use advertising identifiers on Apple devices, we ask for your permission through Apple’s App Tracking Transparency prompt first, and you may decline. You can also reset or limit your advertising identifier in your device settings.
  • App stores, to process purchases, subscriptions and refunds.
  • Professional advisors, such as lawyers, auditors, accountants and insurers.
  • Authorities and others, where required by law or legal process, or where we believe in good faith that disclosure is necessary to protect the rights, property or safety of you, us or others.
  • Business transferees, in connection with a merger, acquisition, financing or sale of assets. We may use, transfer, disclose, or otherwise process your personal information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company, or we sell, liquidate, or transfer all or a portion of our assets. The use of your information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.

We require any third party with whom we share user data to provide the same or equal protection of that data as stated in this Privacy Policy.

6. Your Choices and Rights

  • Your account. You can review and update your account and profile information, and delete individual conversations and memories, in your settings.
  • Deleting your account. You can delete your account in the app, or by signing in at https://www.myzivo.ai and using your account settings.
  • Model improvement. You can opt out by emailing us on support email ID, as described in Section 3.
  • Marketing. You can unsubscribe using the link in any marketing email or through your settings.
  • Cookies and advertising identifiers. You can control cookies through your browser settings, and limit the use of advertising identifiers through your device settings. On Apple devices, where we show the App Tracking Transparency prompt you can decline it, or change your choice later in Settings → Privacy & Security → Tracking.

Depending on where you live, you may have additional rights in relation to your personal information, including to access, correct, delete or receive a copy of it, to withdraw consent, to opt out of the sale of personal information or targeted advertising, and to appeal a decision we make on your request. To exercise any of these rights, email support@myzivo.ai. We may need to verify your identity before acting on your request.

7. Data Retention

We retain your personal information for as long as your account is active and as needed to provide the Services. When you delete your account, we delete your account information, conversations and memories within 90 days, except where we need to retain information to comply with a legal obligation, resolve a dispute, enforce our Terms of Use, or prevent fraud and abuse. We may also retain aggregated or de-identified information that can no longer reasonably be linked to you. Advertising and attribution event data is retained for up to 24 months. Content transmitted to our AI Providers is retained by them only for the limited period necessary for abuse monitoring under our agreements with them, and is not used to train their models.

8. Security

We use reasonable technical and administrative safeguards designed to protect your personal information, including encryption in transit, encryption at rest, and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. International Visitors

Our Services are hosted in the United States (“U.S.”). If you choose to use our Services from other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the U.S. for storage and processing. Also, we may transfer your personal information from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating our Services. For more information about the tools that we use to transfer personal information, or to obtain a copy of the contractual safeguards we use for such transfers (if applicable), you can contact us as described below.

The Services are not offered to, or intended for, individuals located in the European Economic Area or the United Kingdom.

10. Children

The Services are not intended for anyone under 18, and we do not knowingly collect personal information from anyone under 18. If we learn that a user is under 18, we will terminate the account and delete the associated information. If you believe someone under 18 has provided us with personal information, please contact us at support@myzivo.ai.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated policy with a new “Last Updated” date and, where required by applicable law, provide additional notice or seek your consent. Your continued use of the Services after the update takes effect means you accept the revised policy.
